Проаналізовано поняття «медична документація» в контексті сучасного українського законодавства, наукових досліджень і судової практики. Висвітлено нормативно-правове регулювання медичної документації, її основні ознаки та особливості. Запропоновано шляхи вдосконалення законодавства у цій сфері з урахуванням сучасних реформ охорони здоров’я.
The scientific article provides a comprehensive analysis of the concept of «medical documentation» within the current Ukrainian legislation, modern scientific approaches and litigation practice. The author focuses on the importance of clear legal regulation of medical documentation as one of the key elements of the functioning of the health care system. The work describes the main features of medical documentation, its legal nature and functional purpose. The features of medical documents in the context of patients' rights, medical secrecy, electronization of processes in the field of health care are considered. Special attention is paid to gaps and contradictions in the current legislation regulating the circulation of medical records, and the relevant judicial practice is analyzed. Based on the study, a number of recommendations have been proposed to improve legal regulation, in particular in the context of ongoing reforms in the health sector, in order to ensure transparency, accessibility and legal certainty in the management of medical documentation.
