Статтю присвячено оцінки ефективності наказу МОЗ
України № 1793 «Про затвердження Правил визначення медичної придатності особи за
станом здоров'я для роботи на морських суднах чи суднах внутрішнього плавання». Автори
аналізують критерії ефективності наказу – потенційну область та частоту застосування,
конфліктність регульованих питань, досягнення необхідних змін та відношення потенційно
можливих результатів впровадження наказу до практично досяжних. Наказ №1793 досягає
мети виконання Україною своїх міжнародних зобов'язань та гармонізаці їукраїнської
нормативної бази з Директивами ЄС, але матиме обмежену результативність через низку
зовнішніх факторів та не розроблену інструктивну базу.
This article
examines the effectiveness of Order No. 1793 of the Ministry of Health of Ukraine "On Approval
of the Rules for Determining the Medical Status of an Individual for Work on Seagoing Vessels or
Inland Waterway Vessels." The authors analyze the criteria for the order's effectiveness—the
potential scope and frequency of application, the conflicting nature of the regulated issues, the
achievement of the necessary changes, and the ratio of the potential results of implementing the
order to those achievable. Order No. 1793 achieves the goal of fulfilling Ukraine's international
obligations and harmonizing the Ukrainian regulatory framework with EU Directives, but will
have limited effectiveness due to a number of external factors and the lack of a developed
regulatory framework.
