Об’єкти інтелектуальної власності у сфері охорони здоров’я: структура, управління та захист прав власності

Abstract

У статті проаналізовано структуру об’єктів інтелектуальної власності у сфері охорони здоров’я, механізми їх управління та правовий захист. Обґрунтовано стратегічне значення ІВ для медичних установ, висвітлено основні проблеми, пов’язані з недостатнім фінансуванням, відсутністю системного підходу до управління ін телектуальними активами та низьким рівнем правової обізнаності персоналу. Акцент зроблено на необхід ності формування внутрішніх політик управління ІВ та впровадження профільних структур у закладах охо рони здоров’я. Запропоновано модель ефективного управління ІВ, яка включає ідентифікацію, реєстрацію, моніторинг, комерціалізацію та захист прав. Практична цінність роботи полягає в можливості використання результатів для підвищення інноваційної активності та конкурентоспроможності медичних установ в умовах трансформаційних викликів і цифровізації.

The paper defines the role of intellectual property (IP) as a key element in driving innovation and improving healthcare quality. The study focuses on analyzing the structure of IP objects, mechanisms for managing them, and approaches to protecting the rights of medical institutions in Ukraine. Materials and methods. The study uses descriptive and comparative analysis, document review, and statistical methods to examine IP objects in the medical field. Data were collected from registered patents, trademarks, and copyrighted works from public and private healthcare organizations across Ukraine. The study spans the analysis of IP databases from 2020 to 2024, with a specific focus on the types of IP used in healthcare, including patents for medical devices and treatments, trademarks for branding, and copyrights for educational and research materials. Results. The findings indicate significant challenges in the effective use and protection of IP in healthcare, such as limited funding for patent registration, insufficient management strategies, and low awareness among healthcare personnel. However, implementing systemic IP management approaches has shown to enhance the competitiveness and innovation capabilities of healthcare organizations. Institutions with robust IP portfolios report increased economic benefits and better service delivery. Conclusion. The study demonstrates the strategic importance of intellectual property in healthcare and underscores the need for targeted legal and managerial interventions. Effective IP management can significantly contribute to the modernization of healthcare institutions, fostering innovation and ensuring economic sustainability. Future research should explore optimal ways to integrate IP strategies into the operational frameworks of medical organizations. Additionally, the paper highlights the importance of developing institutional policies and dedicated units for IP governance within healthcare providers. Establishing IP offices, training personnel in legal and technological aspects, and implementing digital tools for IP monitoring can ensure sustainable knowledge management and support long-term innovation goals.
